These Terms are a contract between you andPEAK LIT TECH LLC, a Florida limited liability company (“Peak Lit,” “we,” “us”). They apply to peaklittech.com and the PeopleOS HR product. By using the site or PeopleOS, you agree to these Terms and ourPrivacy Policy. If you use PeopleOS for a company, you represent that you can bind that company.

The services
PeopleOS is HR software for US small and mid-size employers (workforce records, time and PTO, documents, and related workflows). Features marked “when live” are not live production money or payment services today. We may change or discontinue features. We do not promise a specific uptime in these Terms.
Peak Lit is not a bank
Peak Lit is not a bank, credit union, money transmitter, or payroll processor. We are not FDIC-insured. We do not take deposits. We do not originate ACH. We do not hold wages. We do not SFTP NACHA or other payment files to customer banks.
Payroll money movement, when live, is through a licensed processor partner we will name when that service is live. Until then, PeopleOS is not direct deposit and not a replacement for your CPA, bank, or payroll vendor. In-product payroll screens may calculate and export files. They do not move money.
If we provide ACH CSV or NACHA downloads, you (the employer) are the Originator. Your bank is the ODFI. You are responsible for submitting that file to your own bank, CPA, or payroll vendor. Providing a download is not origination of a payment and does not make Peak Lit a Third-Party Sender.
Accounts and your responsibilities
You must keep credentials confidential. You are responsible for activity under your accounts, whether PeopleOS is appropriate for your workforce, data accuracy, lawful collection of employee information, access roles, and HR decisions. PeopleOS is a tool. We do not give HR, tax, employment, or legal advice. Do not put employee SSNs in PeopleOS until counsel has cleared that use, especially if you are a school.
You will not misuse the services, violate law, upload malware, resell PeopleOS, or pretend Peak Lit is your bank or payroll processor. We may suspend access for security risk, misuse, non-payment when billing is live, or legal problems.
Billing
PeopleOS billing is currently simulated. We do not claim that we charge cards today. When live, we may use Stripe; fees and renewal will be shown at checkout or on an order form. We do not store full card numbers.
Privacy and third parties
Our Privacy Policy explains how we handle personal information. For PeopleOS workforce data, you (the employer) are the customer and controller. We process that data to provide the service. We do not claim a DPA or SOC 2 report in these Terms. A DPA, if needed, is a separate document.
The services may depend on hosting (to be named when the site is live), Stripe (when live), Discord (contact-form delivery), Google Workspace (when live), and a licensed payroll processor (when live). Their terms apply to their services.
Intellectual property
Peak Lit owns PeopleOS, the site, and our marks. You own your customer data. You grant us a limited right to process that data to provide and secure the service.
Disclaimers and liability
The services are provided as is andas available. We do not warrant that HR calculations or reports are complete or that use of PeopleOS makes you compliant with employment, tax, or wage-hour law. We are not your lawyer, CPA, payroll vendor, or bank.
To the fullest extent allowed by law, we are not liable for indirect or consequential damages, lost profits, payroll failures, or tax penalties. Our total liability is limited to the fees you actually paid us for PeopleOS in the twelve months before the claim, or US $50 if you paid us nothing.
If you are an employer customer, you will defend and indemnify Peak Lit against claims arising from your workforce data, your HR decisions, your misuse of the services, or your putting SSNs into PeopleOS before counsel clears that use.
Term, law, and changes
These Terms apply until you stop using the services or we terminate them. You may close a PeopleOS account as the product allows, or by emailinghello@peaklittech.com.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where US federal law applies. Courts located in Florida will hear disputes, except where applicable law gives you a different forum. These Terms do not add an arbitration clause.
We may update these Terms by posting a new version. Continued use after that date is acceptance, except where a signed order form says otherwise.
